Terms of Service

1. Introduction

Welcome to MotoLogger. These Terms and Conditions ("Terms") govern your use of the MotoLogger mobile application and related services (collectively, the "Service") operated by Paul French, trading as MotoLogger, a sole trader registered in the Republic of Ireland.

Throughout these Terms, "MotoLogger", "we", "us", and "our" refer to Paul French trading as MotoLogger.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Definitions
  • "Service" refers to the MotoLogger application and all related services
  • "User", "you", "your" refers to the individual using the Service
  • "MotoLogger", "we", "us", "our" refers to Paul French trading as MotoLogger
  • "Content" refers to any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, works of authorship, applications, or any other materials
  • "User Content" refers to Content uploaded, submitted, or otherwise made available by users
  • "AI Features" refers to artificial intelligence-powered features including but not limited to chat assistance, maintenance recommendations, and document analysis
3. Account Registration and Security

3.1. You must be at least 18 years old to use the Service.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.4. You must notify MotoLogger immediately of any unauthorized use of your account.

4. Subscription and Payment

4.1. Subscription Plans: The Service offers various subscription tiers, including free and paid options. Details of current plans and pricing are available within the application.

4.2. Auto-Renewal: Paid subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

4.3. Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

4.4. Refunds: MotoLogger does not provide refunds for partial subscription periods, except where required by law.

4.5. Price Changes: MotoLogger reserves the right to modify subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.

5. Acceptable Use and Content Standards

5.1. Prohibited Content: You agree not to upload, post, or transmit any Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
  • Infringes any patent, trademark, copyright, or other proprietary rights
  • Contains viruses, malware, or any other harmful computer code
  • Is false, misleading, or fraudulent
  • Promotes illegal activities or violence
  • Contains personal information of third parties without consent

5.2. Content Removal: MotoLogger reserves the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice and at MotoLogger's sole discretion.

5.3. Account Termination: Violation of these content standards may result in immediate termination of your account.

6. Fair Usage Policy

6.1. The Service is intended for personal, non-commercial use related to motorcycle maintenance and documentation.

6.2. Fair usage limits apply to all accounts:

  • Free accounts: Limited to specified monthly quotas for document uploads and AI queries
  • Paid accounts: Subject to reasonable usage limits as specified in your subscription plan

6.3. Excessive use that impacts service performance for other users may result in temporary restrictions or account review.

7. AI Features Disclaimer

7.1. No Professional Advice: AI-generated suggestions, maintenance recommendations, and chat responses are provided for informational purposes only and do not constitute professional mechanical, technical, or safety advice.

7.2. No Liability for AI Suggestions: MotoLogger expressly disclaims all liability for any actions taken based on AI-generated content. You acknowledge that:

  • AI suggestions may contain errors or inaccuracies
  • You are solely responsible for verifying all maintenance recommendations
  • You should consult qualified mechanics for critical maintenance decisions
  • AI features are tools to assist, not replace, professional judgment

7.3. Accuracy Not Guaranteed: While MotoLogger strives for accuracy, MotoLogger makes no warranties regarding the completeness, reliability, or accuracy of AI-generated content.

7.4. User Responsibility for Maintenance Decisions: You acknowledge that all maintenance decisions are solely your responsibility. The Service provides information, records, and reminders as organisational aids only, not as a substitute for professional mechanical advice. You agree to independently verify any information obtained through the Service, including AI-generated suggestions and maintenance schedules, with qualified professionals before performing safety-critical maintenance. MotoLogger does not guarantee the delivery, receipt, or timeliness of reminders, and you remain responsible for tracking your own maintenance schedules independently of the Service. Failure of reminders to send or arrive does not transfer responsibility for maintenance to MotoLogger.

8. Intellectual Property

8.1. Service Content: All content, features, and functionality of the Service are owned by MotoLogger and are protected by international copyright, trademark, and other intellectual property laws.

8.2. User Content Warranty: By uploading any Content to the Service, you represent and warrant that:

  • You own the Content or have all necessary rights, licences, and permissions to upload and use it
  • Your upload and use of the Content does not infringe any third party's intellectual property rights, including copyright, trademark, or trade secret rights
  • You have obtained any required permissions from third parties whose personal information may be contained in your Content
  • The Content complies with all applicable laws and regulations

8.3. User Content License: By uploading Content, you grant MotoLogger a worldwide, non-exclusive, royalty-free, limited license to use, reproduce, modify, and process your Content solely for the purpose of:

  • Providing the Service to you
  • Processing your documents through AI features (OCR, document analysis, chat responses)
  • Improving the Service (in anonymized, aggregated form only)

This license is limited to what is necessary to operate the Service and does not transfer ownership of your Content.

8.4. No Ownership Claim: MotoLogger does not claim ownership of any User Content you upload. Your documents, photos, manuals, and other materials remain your property. You retain all intellectual property rights in your Content.

8.5. Document Storage:

  • Service manuals: PDF service manuals you add are stored locally on your device and are not uploaded to cloud storage. Only specific pages are temporarily sent for AI processing when you ask questions.
  • Other documents: Registration documents, insurance certificates, invoices, receipts, and similar documents you upload are stored securely in cloud storage under your user account, as described in our Privacy Policy.

8.6. Third-Party Content: You acknowledge that some content you upload (such as manufacturer service manuals) may be protected by third-party intellectual property rights. You are solely responsible for ensuring you have the right to use such materials. MotoLogger does not verify the intellectual property status of uploaded content.

8.7. Feedback: Any feedback, suggestions, or ideas you provide may be used by MotoLogger without any obligation to compensate you.

9. Privacy and Data Protection

9.1. Your use of the Service is subject to MotoLogger's Privacy Policy, which is incorporated into these Terms by reference.

9.2. MotoLogger complies with applicable data protection laws, including the General Data Protection Regulation (GDPR).

9.3. You acknowledge that the Service processes data as described in MotoLogger's Privacy Policy.

10. Third-Party Services

10.1. The Service may contain links to or integrate with third-party services. MotoLogger is not responsible for the content or practices of these third-party services.

10.2. Your use of third-party services is subject to their respective terms and conditions.

11. Disclaimers and Limitations of Liability

11.1. Service "As Is": The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

11.2. No Warranty: MotoLogger disclaims all warranties, including but not limited to:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Accuracy or reliability of information

11.3. Limitation of Liability: To the maximum extent permitted by law:

  • MotoLogger shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • MotoLogger's total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • MotoLogger is not liable for any loss of data, profits, or business opportunities

11.4. Vehicle Safety: You acknowledge that motorcycle maintenance affects safety. MotoLogger is not liable for any accidents, injuries, or damages resulting from maintenance decisions, whether or not based on the Service.

12. Indemnification

You agree to indemnify and hold harmless Paul French, trading as MotoLogger, from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content
  • Any claim that your User Content infringes the intellectual property rights of a third party, including but not limited to copyright, trademark, or trade secret claims
  • Your breach of the warranties in Section 8.2
13. Termination

13.1. MotoLogger may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Conduct that MotoLogger believes harms the Service or other users
  • Extended periods of inactivity
  • Request by law enforcement or court order

13.2. Upon termination, your right to use the Service ceases immediately.

13.3. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, indemnity, and limitations of liability.

14. Changes to Terms

14.1. MotoLogger reserves the right to modify these Terms at any time.

14.2. MotoLogger will notify you of material changes via email or through the Service.

14.3. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law and Disputes

15.1. Governing Law: These Terms are governed by the laws of the Republic of Ireland, without regard to conflict of law principles.

15.2. Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of the Republic of Ireland.

15.3. Dispute Resolution: Before initiating legal proceedings, you agree to attempt to resolve disputes through good faith negotiation.

16. General Provisions

16.1. Entire Agreement: These Terms constitute the entire agreement between you and MotoLogger regarding the Service.

16.2. Severability: If any provision is found unenforceable, the remaining provisions shall continue in full force.

16.3. Waiver: MotoLogger's failure to enforce any right or provision shall not be considered a waiver.

16.4. Assignment: You may not assign these Terms without MotoLogger's prior written consent. MotoLogger may assign rights and obligations without restriction.

16.5. Notice: Notices may be provided via email, through the Service, or by mail to MotoLogger's business address.

17. End User License Agreement (EULA)

17.1. Apple App Store: If you download MotoLogger from the Apple App Store, your license to use the app is subject to the Apple Media Services End User License Agreement (β€œApple Standard EULA”). Apple is a third-party beneficiary of these Terms and may enforce the Apple Standard EULA against you.

17.2. Google Play Store & Sideloaded Builds: For downloads from Google Play or via direct APK, MotoLogger grants you a limited, revocable, non-transferable, non-sublicensable license to install and use the app on devices you own or control for personal use only, subject to these Terms. You may not reverse engineer, decompile, disassemble, or modify the app except as permitted by law.

17.3. Platform Responsibilities: Apple and Google are not responsible for providing maintenance or support for MotoLogger. All support inquiries should be directed to support@motologger.ie. To the extent permitted by law, Apple and Google disclaim all warranties regarding MotoLogger.

17.4. Termination of License: If you breach these Terms, the license granted in this section terminates immediately and you must delete the app from your devices.
